Flock Safety, a surveillance technology company facing increasing scrutiny across
the United States, has announced a series of changes to its license plate camera
platform. The updates are designed to address growing concerns about privacy,
data security, law enforcement access, and the potential misuse of automated
license plate reader technology.
The company operates a large nationwide network of automated license plate
readers, commonly known as ALPRs. These cameras capture license plate numbers
and other details about vehicles passing through their coverage areas. Thousands
of law enforcement agencies across 49 states can search and share information
collected through the system.
Supporters describe the technology as an important public safety and crime-
fighting tool. Police agencies have credited license plate cameras with helping
locate missing people and identify vehicles connected to serious crimes.
However, privacy advocates and civil liberties organizations argue that the
widespread deployment of these systems can create a form of mass surveillance.
They are particularly concerned about how vehicle location data can be accessed,
shared, stored, and potentially used for purposes beyond traditional criminal
investigations.
Flock Safety Announces New Privacy and Accountability Measures
Flock Safety CEO Garrett Langley said several of the company's latest changes are
intended to increase accountability and strengthen safeguards for law
enforcement customers.
Some protections that were previously optional will become mandatory for users
beginning January 1. One major change involves the company's audit system,
which is designed to identify unusual or potentially suspicious search activity.
Under the updated system, law enforcement customers will be required to use an
audit tool intended to detect abnormal searches. When suspicious behavior is
identified, the relevant user can be locked out while an internal review takes place.
The company says the goal is to make it more difficult for officers to use
surveillance databases for inappropriate personal searches.
The changes come after documented cases in which law enforcement personnel
allegedly misused license plate reader systems for reasons unrelated to legitimate
police work.
License Plate Data Retention Will Be Reduced
Another significant update involves the amount of time Flock keeps license plate
information.
The company's standard data retention period will be reduced from 30 days to
seven days. Flock says information connected to an active investigation can still
be preserved through a system known as “Evidence Mode.”
Under this approach, data associated with a specific case number can remain
available instead of automatically being deleted after seven days.
Flock has stated that approximately 90% of searches already take place within a
week of the data being collected.
The shorter default retention period could represent an important change for data
privacy and security, particularly because vehicle information can reveal detailed
patterns about where people travel.
However, privacy advocates argue that the effectiveness of the policy will depend
heavily on how Evidence Mode operates in practice.
If the system preserves only information determined to be relevant to a legitimate
investigation, the policy could reduce unnecessary data storage. But if searches
can result in large amounts of information being retained for extended periods,
critics warn that the new system could still create substantial privacy risks.
Local Agencies May Gain More Control
Flock Safety also says local governments and police departments will receive
greater control over how other agencies can access their license plate data.
For example, one city could allow another law enforcement agency to search its
camera information for stolen vehicles or violent crimes while preventing searches
associated with immigration enforcement.
According to the company, this approach would allow communities to establish
policies that better reflect their own priorities and local values.
The proposal is particularly significant because license plate databases can
contain information about vehicles that have never been connected to a crime.
Privacy advocates, however, remain skeptical.
The American Civil Liberties Union has pointed to previous problems involving
Flock's efforts to restrict certain searches. The organization argues that simply
creating restrictions does not guarantee that officers will use the system
appropriately.

users from bypassing them.
Concerns Over Police Miuse Remain

These searches, sometimes described as “curiosity searches,” are searches
conducted without a legitimate law enforcement purpose.
Researchers and civil liberties advocates have argued that such behavior should
have been anticipated because similar problems have occurred with other law
enforcement databases.
Flock says its audit system can help identify suspicious activity. The company has
also pointed to cases where officers were arrested, dismissed, or disciplined after
allegedly misusing the technology.
Critics say that evidence alone does not establish how effective the auditing
system actually is.
Without knowing how many inappropriate searches occur in total, it is difficult to
determine whether the technology identifies most violations or only a small
percentage of them.
For that reason, privacy advocates have called for independent evaluation of
Flock's auditing technology.
An independent assessment could help determine whether the system provides
meaningful data protection or primarily functions as a compliance and public
relations measure.
Case Codes Will Become Mandatory
Flock is also changing how police officers initiate searches.
Under the new policy, law enforcement users will have to provide a code from their
records management system connecting a search to a specific case before
conducting it.
The company says this requirement is intended to ensure that searches have a
legitimate investigative purpose.
Emergency situations can still receive exceptions, but those overrides will
automatically be flagged for review.
The idea is straightforward: every search should have a documented reason.
Yet critics argue that similar requirements have existed before and have not always
prevented misuse.
The controversy demonstrates the difficulty of balancing law enforcement
technology with privacy protections. A security measure may look strong on
paper, but its effectiveness ultimately depends on whether users can bypass it and
whether violations are detected afterward.

The ACLU described the shorter default retention period as potentially positive
while criticizing several of the other measures as inadequate or similar to previous
safeguards.
Robert Frommer, a senior attorney at the Institute for Justice, argued that the
changes do not resolve the fundamental concern over who should authorize
searches of surveillance data.
Andrew Guthrie Ferguson, a George Washington University Law School professor
who studies policing, big data surveillance, and constitutional issues, viewed the
changes as an improvement compared with having no safeguards.
At the same time, he called for continued public discussion and stronger judicial
oversight of access to surveillance information.
The debate reflects a larger national discussion about digital privacy, government

As surveillance systems become more powerful, lawmakers and communities are

reader technology, more than 50 agencies or jurisdictions have canceled,
suspended, rejected, or deactivated Flock-related contracts since the beginning of
the year.
Some surveillance cameras have also been vandalized.
Meanwhile, members of Congress have introduced legislation aimed at restricting
the use of license plate reader technology.
The growing opposition suggests that the debate over automated vehicle
surveillance is becoming increasingly political and public.
Although Flock is not the only company offering automated license plate reader
technology, the company has become a major focus of the national conversation.
The Future of Flock Safety and Privacy
Flock Safety says its latest changes are intended to improve accountability,
strengthen local control, and address concerns about inappropriate surveillance.
The company maintains that its customers own the data collected by its cameras
